Most people in Jersey City rent, and most rent in a building with shared walls, shared hallways and a lease. That raises a practical question about cannabis: can you use it at home? The short answer is that New Jersey law says you may use it in private spaces, but landlords and property owners can say no. This guide explains what that means for renters, how delivery to an apartment works, and how to be considerate to your neighbors. It is general information, not legal advice, and it is for adults 21+.
The Quick Answer
- The state allows use in private spaces, but the New Jersey Cannabis Regulatory Commission (CRC) says property owners and landlords may restrict cannabis use on their property.
- Your lease and building rules matter most. Read them, and ask your landlord or management if you are not sure.
- Home growing isn’t allowed in New Jersey.
- Delivery to your apartment works, if you give clear entry instructions and someone 21+ is there with ID.
What the State Says
According to the CRC, you may use cannabis in private spaces, and landlords may prohibit cannabis use on their property. The CRC also says smoking is allowed where cigarette smoking is permitted, unless stated otherwise, which means smoke-free building policies and similar rules can apply. In practice, the rule that matters to a renter is the one in the lease or building policy.
Read Your Lease
Look for:
- A smoking policy. Many buildings prohibit smoking anywhere on the property, including inside units and on balconies.
- A nuisance or odor clause. Smells that travel through shared walls and vents can cause complaints.
- Rules about illegal activity. Some leases mention federal law, under which cannabis is still illegal.
- Rules for common areas, lobbies, roofs and courtyards.
If the lease is unclear, ask your landlord or property manager in writing. If you have a legal question about your lease, talk to a qualified attorney or a tenants’ organization.
Options if Smoking Isn’t Allowed
If your building bans smoking, you still have choices that don’t involve smoke:
- Edibles and drinks. No smoke or odor. See our edibles guide, dosing guide and drinks guide.
- Vapes. They produce less odor than smoke, but many policies cover vaping too. Check the wording. See the vapes guide.
- Topicals. Applied to the skin, with no smoke. See our topicals guide.
Always check whether your policy covers these formats. A ban on smoking does not necessarily mean a ban on everything, but the wording matters.
Being a Good Neighbor
- Keep odor contained. Store cannabis in a sealed container.
- Respect shared spaces. Don’t use in hallways, stairwells or entrances.
- Mind your balcony. Smoke carries to the neighbors above and below.
- Keep it away from children and pets. That includes guests’ children.
Delivery to an Apartment
CREAM delivers across Jersey City and 21 other North Jersey cities. For an apartment:
- Add your unit number and any buzzer code at checkout.
- Tell your doorman or front desk, if you have one.
- Be ready to come down, or meet the driver at the door. Someone 21 or older must receive the order and show valid ID.
- Keep your phone on. The driver may call to find the entrance.
Delivery has no minimum order, is free over $70 and $5 under, and isn’t available to federal buildings or college campuses. See how weed delivery works, and check your address on the delivery page. For high-rise and brownstone tips, see our Downtown neighborhood guide.
Roommates and Guests
If you share your apartment, agree on rules with your roommates first: where cannabis is stored, where it can be used, and who is allowed to. Never share with anyone under 21. You may give up to 1 ounce to another adult 21 or older, but you can’t accept payment for it.
Storage
Use a sealed container, somewhere cool, dark and out of sight, and out of reach of children and pets. See our storage tips.
What Not to Do
- Don’t grow plants at home. It is not allowed.
- Don’t use in shared areas of your building.
- Don’t ignore a notice from your landlord. Respond in writing and, if needed, get advice.
- Don’t drive after using cannabis.
Responsible Use
Use only where you are allowed to, never drive after using cannabis, and keep it out of reach of children and pets. For the wider rules, see our guide to New Jersey cannabis laws.
If You Get a Notice From Your Landlord
- Read it carefully, and note which rule it cites.
- Respond in writing, and keep a copy.
- Stop the activity it describes while you sort it out.
- Get advice from a qualified attorney or a tenants’ organization if you are unsure of your rights.
Moving Into a New Place
If you are apartment-hunting, ask about the smoking policy before you sign, and get the answer in writing. Many Jersey City buildings are smoke-free, and it is much easier to ask first than to find out afterwards.
