New Jersey Cannabis Laws: Possession Limits, Where You Can Use It and Driving

New Jersey has legal adult-use cannabis, with rules. This guide summarizes purchase and possession limits, where you can use it, driving penalties, gifting, home growing and crossing state lines, using the CRC as the source.

New Jersey has legal adult-use cannabis, but “legal” comes with rules: how much you can buy, how much you can carry, where you can use it, and what happens if you drive. This guide summarizes those rules in plain English, using the New Jersey Cannabis Regulatory Commission (CRC) as the source. It is general information, not legal advice, and laws and guidance change, so check the CRC’s official pages and talk to a qualified attorney for your situation. It is for adults 21+.

The Quick Answer

  • Who: adults 21 and older, residents or visitors.
  • Buying: up to the equivalent of about 1 ounce per transaction.
  • Having: adults may possess up to 6 ounces of cannabis and cannabis products, per the CRC.
  • Using: the safest place is private property where the owner allows it. Landlords and property owners can prohibit it.
  • Driving: driving under the influence of cannabis is illegal and prosecuted like alcohol DUI.
  • Travel: you may not take cannabis across state lines, in any amount.

Age and ID

Adult-use cannabis is for people 21 and older. The CRC says this includes visitors to the state as well as residents. Dispensaries must check a government-issued ID, and the CRC says they may not copy it or keep purchase records beyond the transaction. At CREAM, bring a valid, unexpired government-issued photo ID. For more on a first visit, see our first-visit guide.

How Much You Can Buy

Dispensaries can sell up to about 1 ounce (28.35 grams) of usable cannabis per transaction, with equivalency limits for other product types such as edibles and concentrates. A dispensary applies those limits at checkout.

How Much You Can Have

The CRC’s page says adults may have up to 6 ounces of cannabis and cannabis products in their possession. That is different from the purchase limit, which applies to a single transaction. Keep your purchase in its original packaging, and sealed until you are home.

Where You Can Use It

This is where people get confused, so here is what the CRC says:

  • Private spaces: you may use cannabis in private spaces, but property owners and landlords may prohibit it on their property.
  • Smoking: the CRC says cannabis smoking is allowed where cigarette smoking is permitted, unless stated otherwise. In places where smoking is banned, cannabis smoking is banned too.
  • Licensed consumption areas: use is allowed where an establishment is licensed and zoned for on-site consumption. Patrons must be 21+, and they can’t leave with open packages.
  • Federal property: you cannot use cannabis on federal lands or in federal buildings.

Because local rules, building rules and signage all apply, the simplest approach is to use cannabis at home, with the permission of whoever owns or manages the place. See our guide to cannabis and apartments.

Driving

The CRC is direct: it is illegal to drive under the influence of any intoxicating substance, including cannabis, whether used recreationally or medically. The effects of cannabis can last for several hours, and tolerance does not make you a safe driver. Police may use trained Drug Recognition Experts and other evidence to determine impairment.

Penalties are similar to alcohol DUI. According to the CRC, a first offense can include a license suspension of 7 months to a year, a fine of $300–$500, and possible jail time, with steeper penalties for repeat offenses. The penalties are listed on the CRC’s page, and they can change, so check there for the latest.

The simple rule is the one printed on every package: never drive after using cannabis. Plan a ride, use at home, and wait.

Sharing and Gifting

You may give up to 1 ounce of cannabis to another adult 21 or older, but you may not accept any payment or compensation for it. Selling without a license is not allowed.

Home Growing

The CRC says New Jersey’s legislation does not allow personal growing. The only legal source for adult-use cannabis is a licensed dispensary.

Crossing State Lines

It is illegal to transport cannabis across state lines, in any amount, and you cannot mail it. That matters in Jersey City, where New York is a short PATH ride away. Don’t bring cannabis with you. For more on visiting, see our guide for visitors buying cannabis in New Jersey.

Work

The CRC says employers may prohibit cannabis at work and may require drug testing when work procedures or safety are at stake. If you work in a safety-sensitive job, check your employer’s policy before you use cannabis.

Medical Patients

Medical cannabis patients have their own program, with its own purchase limits. See our medical patient guide.

Practical Habits

  1. Keep cannabis in its original packaging, sealed, until you are home.
  2. Store it out of reach of children and pets.
  3. Use only where you have permission, and not around others who haven’t agreed.
  4. Don’t drive after using, and don’t let others.
  5. When unsure about a rule, ask, or don’t.

Where to Check

The CRC’s website is the authoritative source for the state’s rules, and a qualified attorney can advise on your situation. Rules can change, and local governments may add their own.
