These are the terms that apply when you use cream.online or buy from CREAM at 284 1st Street, Jersey City. We tried to keep the legalese minimal. If anything is unclear, email info@cream.online and ask.
By using cream.online, browsing our menu, placing an order, or buying anything from CREAM Dispensary at 284 1st Street, Jersey City, NJ, you agree to these Terms of Service. You also agree to our Privacy Policy. If you don't agree with either, please don't use our site or buy from us.
"CREAM," "we," "us," and "our" mean CREAM Dispensary, the licensed New Jersey cannabis retailer at the address above. "You" means whoever is using the site or making a purchase.
These terms apply alongside any in-store signage, receipt language, and instructions from our staff. If our staff tells you something specific (for example, that an item can't be sold to you for a state-law reason), that instruction governs even if it's not written here.
To use this site or buy from CREAM, you must be at least 21 years old and able to present a valid government-issued photo ID at the time of every transaction. Acceptable IDs: U.S. driver's license, U.S. state ID card, U.S. passport, U.S. military ID, or a foreign passport (with another form of ID for delivery).
We do not sell to anyone under 21. Period. We do not sell to anyone whose ID we cannot verify, regardless of how legitimate it appears. We do not allow anyone under 21 inside the dispensary, including minor children of customers. Delivery drivers will not leave product without verifying ID at the door — if no qualifying adult is present, the order returns to the store.
Purchasing cannabis with the intent to resell, redistribute to a minor, or transport out of New Jersey violates these terms and state and federal law. We cooperate with law enforcement on suspected violations.

We may suspend or close accounts, decline orders, or refuse service for any of these reasons. If we suspect criminal activity, we will report it.
Our online menu pulls real-time inventory and pricing from our point-of-sale system. We try to keep it accurate. Cannabis retail moves fast — a product may be in stock when you add it to your cart and out of stock by the time you check out. Prices and promotions can change without notice. Lab-test certificates, THC/CBD percentages, and product descriptions reflect what we received from the manufacturer; we don't independently re-test what's already lab-tested at the cultivator level.
If a price displayed on the site is obviously wrong (a $40 eighth listed for $4 due to a system error, for example), we reserve the right to cancel the order before fulfillment and refund any payment in full. We won't honor obvious mistakes — but we will tell you immediately and offer the correct price.
Photographs of products are illustrative. Cannabis is an agricultural product; appearance varies between batches.
Placing an order is your offer to buy at the listed price. Our acceptance happens when we confirm the order — not when you click "place order." We reserve the right to decline any order for any lawful reason, including suspected fraud, ID problems, inventory issues, or delivery zone restrictions.
Order limits per New Jersey state law apply: we cannot sell more than the legal possession limit per customer per day, and our system tracks transactions to prevent over-purchase. If your order exceeds the limit, we will cancel or modify it and let you know.
You can cancel an order before it's been packed for fulfillment by contacting us at info@cream.online or 848.500.9333. Once an order is in our delivery driver's hands, it cannot be cancelled — though if no qualifying adult answers the door, the driver will return product to the store and we'll work with you on a refund minus delivery cost.
Pickup orders are held at the counter for 24 hours. Bring the same ID you used to place the order. If the names don't match, we cannot release the order to you — no exceptions. Unclaimed pickup orders are restocked and refunded after 24 hours.
We deliver within a 15-mile radius of our Jersey City dispensary, during posted delivery hours. Delivery requires a $50 minimum order before tax. Orders from $50 to $70 include a $5 delivery fee, and delivery is free on orders over $70. Orders below $50 are not available for delivery — pick up in-store, or add items to reach the threshold. Drivers will verify a valid ID showing 21+ at the door, every time, no exceptions. The name on the ID must match the name on the order. If you can't produce ID, the driver will return the product to the store. You may be charged the delivery fee.
All cannabis sales are final. Once cannabis leaves our licensed premises (across the counter or out the door for delivery), we cannot legally accept it back, restock it, or resell it. This is mandated by New Jersey Cannabis Regulatory Commission rules — it is a chain-of-custody and security requirement, not a CREAM policy choice.
The one exception: if a product is defective at the time of sale — packaged incorrectly, sealed product is contaminated, vape battery doesn't fire — bring the unused remainder back within 7 days with your receipt and we will work with you on a replacement or store credit. We document defective product per state regulation and return it to the manufacturer through compliance channels.
We do not refund for "didn't like the effects," "wasn't strong enough," "wasn't what I expected," or any other subjective reason. Cannabis effects vary by individual, dose, tolerance, and setting; that's not a defect. Our budtenders can help you choose products that suit you better next time.
Non-cannabis accessories (rolling papers, lighters, etc.) are returnable in their original unopened packaging within 14 days with receipt.
Cannabis remains illegal under federal law, which makes payment processing more complex for dispensaries than for typical retailers. In store, we accept cash, debit, and credit cards at the counter; an ATM is available on-site. For delivery orders, we accept Pay By Bank (a secure one-time ACH transfer through your bank app) only — credit and debit cards are not supported for delivery due to processing restrictions. Current accepted methods are always shown at checkout.
All prices are in U.S. dollars. New Jersey adult-use cannabis sales tax (currently 6.625% state plus 2% local) applies to recreational orders. Medical patients save 15% on every order with a valid NJ MMCP card — see Medical for details. Discount stacking rules vary by promotion; the 07302-zip-code local discount applies to in-store visits only and does not stack with other promotions unless explicitly noted.
Chargebacks for properly delivered cannabis are a violation of these terms. If you dispute a transaction with your card issuer for cannabis you actually received, we will provide the issuer with delivery confirmation, ID verification record, and signed receipt where applicable. We may suspend service to accounts that initiate fraudulent chargebacks.
Every product we sell has been tested by a state-licensed New Jersey laboratory for cannabinoid content (THC, CBD), terpenes, and contaminants (residual pesticides, heavy metals, microbials, residual solvents). Lab certificates of analysis (COAs) are available on request. Our budtenders can speak to flavor, effect, and growing-style differences between strains — but they cannot diagnose conditions, prescribe products, or make medical claims.
Cannabis is not approved by the U.S. Food & Drug Administration to treat any medical condition. Statements about cannabis effects on this site, our packaging, or from our staff are not medical claims and have not been evaluated by the FDA. Cannabis is not intended to diagnose, treat, cure, or prevent any disease. If you are using cannabis for a health condition, consult a licensed physician.

Cannabis remains a Schedule I controlled substance under U.S. federal law. Transporting cannabis across state lines is a federal felony, even between two states where cannabis is legal. The legal cannabis you buy from CREAM in New Jersey is illegal the moment it crosses into Pennsylvania, New York, or any other state — including by car, train, plane, mail, or rideshare.
Do not bring CREAM products to airports. Do not mail or ship them. Do not give them to someone you know is traveling out of state. We are not responsible for legal consequences if you transport our products across state lines.
The CREAM name, logo, wordmark, color palette, taglines ("Jersey City's worst kept secret," "Cloud Nine, On Time"), site copy, and visual design are the property of CREAM Dispensary. You may not use any of them without our written permission, except for fair-use purposes like product reviews, news commentary, or your own personal social media tagging us.
Brand names, product names, and packaging of cannabis products we sell are the property of their respective manufacturers. Our menu listings refer to those products by their proper trade names; this is not an endorsement or sponsorship arrangement unless we say so.
If you submit a review, comment, photo, or other content to us — by email, social media, or via this site — you grant us a non-exclusive, royalty-free license to use it for promotional purposes (with attribution if you like, anonymous if you prefer). You confirm the content is yours to share. You can revoke this license going forward by emailing us; existing uses (printed materials, sent emails) may persist.
The site and our products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties — express, implied, statutory, or otherwise — including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the site will be uninterrupted or error-free.
We do not warrant that any specific product will produce any specific effect for any specific person. Cannabis affects different people differently; that's biology, not a defect.
To the fullest extent permitted by New Jersey law, CREAM is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of our products or this site, including lost profits, lost data, business interruption, or personal injury arising from your own misuse of cannabis.
Our total cumulative liability to you for any matter arising out of these terms is limited to the amount you paid us in the 90 days preceding the event giving rise to the claim, or $100, whichever is greater.
You agree to indemnify and hold CREAM, its owners, employees, and contractors harmless from any claim, demand, or expense arising from your violation of these terms, your violation of any law, or your misuse of products purchased from us. This includes if you give cannabis to a minor or transport it across state lines and we get blamed for it.
Nothing in this section limits liability that cannot be limited under New Jersey or federal law (for example, liability for personal injury caused by our gross negligence or willful misconduct).
These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute arising from these terms or from your use of our site or products will be brought exclusively in the state or federal courts located in Hudson County, New Jersey, and you consent to the personal jurisdiction of those courts.
We're not enthusiastic about lawyers either. Please email info@cream.online with the subject line "Dispute" before filing anything. We will engage in good-faith informal resolution for at least 30 days before any party files suit. Most disputes are resolved this way.
We may revise these Terms from time to time. The effective date at the top of this page reflects the current version. For material changes, we will post a notice on this page and, where you've given us your email address, send a notification at least 14 days before the change takes effect. Your continued use of the site or purchases after a revision becomes effective constitutes acceptance of the revised terms.
