Visiting New Jersey? Buying Cannabis With an Out-of-State ID (and What You Can't Take Home)

Visitors 21 and older can buy cannabis in New Jersey, but a few rules catch people out, the biggest being that it can't leave the state. Here is what to bring, what to buy and where to use it.

Visiting Jersey City from out of town, or just across the river? Adult-use cannabis is legal in New Jersey, and you don’t have to live here to buy it. But visitors face a few rules that locals don’t think about, the biggest being that cannabis can’t leave the state. This guide covers what a visitor needs to know about buying cannabis at CREAM: ID, limits, where to use it, and what to do before you head home. It is general information, not legal advice, and it is for adults 21+.

The Quick Answer

  • Visitors can buy. The New Jersey Cannabis Regulatory Commission (CRC) says adult use is open to anyone 21 or older, residents or visitors.
  • Bring a valid government-issued photo ID. Dispensaries must check one.
  • Don’t take it home across state lines. It is illegal to transport cannabis out of New Jersey, in any amount.
  • Plan where you will use it. Hotels, rentals and public places each have their own rules.

ID for Visitors

CREAM needs a valid, unexpired government-issued photo ID showing you are 21 or older. The CRC says dispensaries must check a government-issued ID, and may not copy it or keep purchase records beyond the transaction. If your ID is from another state or another country, call (848) 500-9333 before you visit to confirm it will be accepted, so you don’t make the trip for nothing. Expired IDs aren’t accepted.

How Much You Can Buy

Dispensaries can sell up to about 1 ounce per transaction, with limits for other product types. As a visitor, you buy under the same rules as everyone else. Our guide to New Jersey cannabis laws has the details.

You Can’t Take It Home

This is the one that catches visitors. The CRC says it is illegal to transport cannabis across state lines, and you can’t mail it either. That applies even if you are going to a state where cannabis is legal. If you are visiting from New York, remember that the PATH train crosses the state line. Buy what you will use here, and use it or leave it before you go.

Practical ways to handle it:

  • Buy a small amount, sized to what you will use during your stay.
  • Choose single-use formats, like a pre-roll or a single-serving edible, so there is nothing left over.
  • Don’t carry it onto a flight, a train or a bus out of state.

Where You Can Use It

This is the other tricky part for visitors, who often have no private space of their own.

  • Hotels and short-term rentals: most have their own policies, and many prohibit smoking and cannabis. Check with your host or the front desk before you use.
  • Public places: the CRC says smoking cannabis is allowed where cigarette smoking is permitted, unless stated otherwise, and banned where smoking is banned. Rules vary by location, so don’t assume.
  • Federal property: not allowed.
  • Licensed consumption areas: allowed where an establishment is licensed and zoned for on-site consumption.

If you don’t have a clear place to use it, think carefully about whether to buy it at all. An edible or a pre-roll is no use if you can’t use it where you are staying.

Driving

Don’t drive after using cannabis. Driving under the influence of cannabis is illegal in New Jersey, and prosecuted like alcohol DUI. If you are visiting, use a ride service or transit.

Getting Here

CREAM is at 284 1st Street, Jersey City, NJ 07302, in the Powerhouse Arts District. The Grove Street PATH station is about a 5-minute walk, and PATH runs to Manhattan, so Jersey City is an easy day trip. For every route, see how to get to CREAM. If you are staying in Jersey City, same-day delivery may be easier. Delivery isn’t available to federal buildings or college campuses, and it requires an address within our area. Check the delivery page.

Discounts

The 15% local discount is for 07302 residents, so most visitors won’t qualify. Veterans save 10% on all orders with valid ID. CREAM Rewards earns 5% back in points, which never expire, so it is only useful if you plan to return. See our discount guide.

Medical Patients From Other States

CREAM’s medical discount is for active New Jersey medical program cardholders. An out-of-state medical card doesn’t qualify for it. You can still shop adult-use with a valid ID.
