Holiday Travel and Cannabis: Newark Airport, TSA and State-Line Rules

Legal in New Jersey does not mean legal everywhere. Here is what TSA and the state say about airports and state lines, and how to plan so your trip isn't at risk.

Holiday travel is the time of year when the question comes up: can I take cannabis with me? The short answer is no, not across state lines, and not through an airport. Legal in New Jersey does not mean legal everywhere, and airports are governed by federal law. This guide explains what the Transportation Security Administration (TSA) and the state say, what happens if cannabis is found at a checkpoint, and how to plan so you don’t put your trip at risk. It is general information, not legal advice. It is for adults 21+.

The Quick Answer

  • Don’t bring cannabis to the airport, including Newark Liberty, in carry-on or checked bags.
  • Federal law still applies at airports, even in states where cannabis is legal.
  • New Jersey says it is illegal to transport cannabis across state lines.
  • Buy it when you are back, not before you leave.

What TSA Says

According to TSA, marijuana remains illegal under federal law, and its policy is the same in every state and at every airport, including for medical marijuana. TSA officers don’t search for it, but if they find it while screening carry-on or checked bags, they notify airport law enforcement, and what happens next is up to law enforcement. TSA’s policy doesn’t change depending on where you are flying from or to.

Products with no more than 0.3 percent THC on a dry weight basis, and FDA-approved products, are treated differently under federal law. Rules on hemp and CBD vary, so check with the airline and TSA’s website for the specific product you are carrying.

What New Jersey Says

The state’s Cannabis Regulatory Commission says it is still illegal to transport cannabis across state lines. That applies to driving to Pennsylvania or New York, taking PATH to Manhattan, and flying anywhere. See our guide to New Jersey cannabis laws.

Other States

Laws differ widely. Some states allow adult use, some allow only medical use, and some prohibit it entirely. Possession limits and public-use rules also differ, even between cities. Your New Jersey purchase doesn’t carry over, and neither does a New Jersey medical card in most places. Check the laws at your destination before you go, and plan to buy there only if it is legal and you are eligible.

How to Plan Before You Travel

  1. Use up or store what you have. Don’t buy more than you will use before you go.
  2. Leave it at home, locked away, especially if anyone else will be in the house. See safe storage tips.
  3. Check your bags before you leave. Coat pockets, pouches and travel cases are easy to forget.
  4. Dispose of what you can’t keep. Don’t leave it at the airport.
  5. Plan to restock when you return. Delivery and pickup are available. See order-ahead pickup and how delivery works.

Vapes, Edibles and Accessories

The rules apply to all cannabis products, including vape cartridges, edibles, concentrates and pre-rolls. Accessories that contain residue can also draw attention. When in doubt, don’t pack it.

Getting to Newark Airport From Jersey City

Many people reach Newark Liberty by PATH and rail, or by rideshare. Plan your route in advance, and allow extra time in a holiday week. If you are coming from Newark Penn Station, see the Newark Penn Station guide.

Coming Home

When you return, you can order ahead for pickup or schedule delivery. Remember that delivery isn’t available to federal buildings or college campuses, and that you need a valid ID showing you are 21 or older. Check the delivery page for your address.

Visitors Coming to New Jersey

If you are visiting, you can buy here if you are 21 or older, but you can’t take it home with you. See visiting New Jersey and buying cannabis.
