Cannabis can feel like an easy holiday gift, but New Jersey has specific rules about giving it away, and some common ideas fall on the wrong side of the line. This guide explains what the state’s Cannabis Regulatory Commission (CRC) says, what you can give, what you can’t, and some safer gift ideas that don’t involve handing over cannabis. It is general information, not legal advice. It is for adults 21+.
The Quick Answer
- You may give up to 1 ounce (28.35 grams) to another adult 21 or older, according to the CRC.
- You may not accept payment or compensation for it. It must be a true gift.
- Never to anyone under 21.
- Don’t take it across state lines. That is still illegal.
What the State Says
The CRC’s adult-use page says adults may give up to 1 ounce of cannabis to another adult who is 21 or older, and that they may not accept payment or compensation. It also says adults 21 and older may possess up to 6 ounces, and that it is illegal to transport cannabis across state lines. See our guide to New Jersey cannabis laws.
What Counts as a Gift, and What Doesn’t
- A gift: you give a friend a sealed pre-roll, with nothing asked in return.
- Not a gift: “I’ll give you this if you cover my dinner,” a trade for a favor, or a price disguised as a donation. That is compensation.
- Not a gift: a free item bundled with something you sell. State officials have warned businesses against “giving away” cannabis with other purchases, so be wary of any arrangement like that.
If you are unsure whether something counts, don’t do it.
Who You Can Give It To
- An adult who is 21 or older. Check, since you are responsible for who you give it to.
- Someone who wants it. Don’t surprise anyone with cannabis, particularly in a workplace or a family setting.
- Not to anyone under 21, including at a family gathering.
Practical Tips
- Keep it in the original packaging, with its labels and warnings.
- Deliver it in person, and don’t mail it or send it with a courier. Mailing cannabis is a federal issue.
- Stay within the 1 ounce limit, and keep your own possession within 6 ounces.
- Don’t gift across state lines, including to someone in New York.
- Tell the recipient how to store it, locked away from children and pets.
Gift Ideas That Aren’t Cannabis
If you are not sure the recipient would want it, or you want a gift with no legal questions, consider accessories and lifestyle items instead:
- A lockable storage box. See why storage matters.
- A grinder, tray or storage jar. See our accessories guide.
- A vape battery or charger. See how to use a vape.
- A first-time guide: our microdosing guide is a good one to pass along.

At Work and With Family
Employers can have their own drug policies, and cannabis in the workplace can cause problems even where it is legal. Families differ too, so ask before you give. A gift that puts someone in an awkward spot isn’t much of a gift.
After You Give It
- Remind the recipient never to drive after using cannabis.
- Remind them to use only where it is allowed. See where you can use cannabis in Jersey City.
