Licensed Cannabis vs. the Illicit Market in New Jersey: What You Can and Can't Know

The difference between licensed and unlicensed cannabis is bigger than price. Here is what licensing means, what a label tells you and how to shop with confidence.

With the holidays, more people look for cannabis to give, share or stock up on, and some are tempted by a cheaper deal from a friend of a friend, a delivery app or a pop-up. In New Jersey, the difference between licensed and unlicensed cannabis is bigger than price. This guide explains what licensing means, what you can check on a package, why unregulated products carry more unknowns, and how to shop with confidence. It is general information, not legal advice. It is for adults 21+.

The Quick Answer

  • Licensed products are tested and labeled under rules set by the Cannabis Regulatory Commission (CRC).
  • Unlicensed products aren’t, so you have no reliable way to know what is in them.
  • Testing isn’t perfect, which is why reading the label and buying from a store you trust still matters.
  • Selling cannabis without a license is illegal, and so is paying for it.

What “Licensed” Means

New Jersey licenses growers, manufacturers and retailers, and the CRC sets rules for testing, packaging and labeling. Licensed products are tested by approved labs before they reach shelves, and labels list information such as THC and other cannabinoid content. In February 2025, the CRC updated its testing rules, with new contaminant limits by product type, smaller testing batches for flower, and labels that list more cannabinoids than before. The CRC says it inspects licensed facilities and responds to labeling and testing complaints.

What the Label Tells You

  • Product type and weight
  • THC and other cannabinoid content
  • Batch and testing information
  • Warnings, including 21+ and not-for-children notices
  • For edibles, the dose per serving, capped at 10 mg in New Jersey

What You Can’t Know From an Unlicensed Seller

  • The dose. An unlabeled edible might contain far more than you expect, and edibles are the product where that matters most. See edible dosing.
  • Contaminants. Without testing, there is no check for things like mold or pesticides.
  • What a vape contains. Unregulated cartridges are a particular concern, because the oil and any additives are unknown.
  • Who you are dealing with. There is no ID check, no accountability and no recourse if something goes wrong.

We make no claim that any particular product causes any particular harm. The point is that you can’t verify what you are getting.

Licensed Isn’t Risk-Free

Testing programs can have gaps, and there have been public reports raising questions about test results and labeling in New Jersey’s licensed market. The CRC has said it investigates complaints and takes action on violations. For you as a shopper, that means:

  • Buy from a licensed store, and ask questions.
  • Check that the package is sealed, with its label intact.
  • Start with a low dose of any new product.
  • If something seems wrong, such as a strange smell, taste or effect, stop using it and contact the store or the CRC.

Only licensed businesses may sell cannabis in New Jersey. Buying from an unlicensed seller can carry legal risk, and gifting rules are strict: you may give up to 1 ounce to another adult 21 or older, with no payment or compensation. See gifting cannabis in New Jersey and New Jersey cannabis laws.

Spotting Red Flags

  • No ID check, or no minimum age.
  • Sales through social media, messaging apps or unmarked cars.
  • Unlabeled or generic packaging, or packaging copying a known brand.
  • Prices far below the licensed market.
  • Sellers who can’t tell you what is in the product.
